Submissions to the Review of the Closing Loopholes Acts have closed.

The Government has combined the reviews of the Fair Work Legislation Amendment (Closing Loopholes) Act 2023 and the Fair Work Legislation Amendment (Closing Loopholes No.2) Act 2024 for simplicity into a single review, the Closing Loopholes Review.

The review will also further consider the effectiveness of the paid family and domestic violence leave entitlement legislated in the Fair Work Amendment (Paid Family and Domestic Violence Leave) Act 2022, as committed to in the Australian Government response to the 2024 independent review of that Act.

The Hon Amanda Rishworth MP, Minister for Employment and Workplace Relations Reviewer, has appointed Ms Susan Booth to conduct the review.

The review will consider:

  • whether the operation of the amendments is appropriate and effective

  • any unintended consequences of the amendments

  • whether further amendments to the Fair Work Act 2009, or any other legislation are necessary to improve the operation of the amendments to rectify any unintended consequences that are identified.

The review will also consider any relevant qualitative and quantitative research.

Preliminary findings and draft recommendations are due to the Minister by 15 May 2026, and will be published for stakeholder comment
